Small New Group Files Lawsuit against UIGEA

An organization called the Interactive Media Entertainment and Gamming Association has filed a lawsuit against U.S. Attorney General Alberto Gonzales in an attempt to stop the Unlawful Internet Gambling Enforcement Act. The lawsuit was filed on Tuesday June 5, 2007 in the U.S. District Court of New Jersey. Their argument is that the UIGEA violates constitutional rights and has the potential to cause extreme legal problems regarding the regulating and policing online commerce. If the case is granted, then the injunction would for a cause to the UIGEA to temporarily be not in effect while the court considered the case.

iMEGA organization describes itself as a group that motivated by motivated by "the fair, equitable, and rational governance of interactive Internet commerce and communications." According to iMEGA's attorney, Eric M. Bernstein "Americans from engaging in their fundamental rights to conduct their lives in the manner they wish to live it -- to be free from the government imposing public morality in the privacy of one's home."

Furthering iMEGA’s argument, the lawsuit stipulates that the UIGEA's illegalization of online money transfers based on how those funds are used sets up a dangerous precedent for commercial internet business in general. In support of their argument, iMEGA is citing the World Trade Organization's ruling that the UIGEA puts the United States in a position that violates trade agreements with Antigua and Barbuda.
